초록
법률에 대한 최종 해석 권한은 법원에 있다. 법원은 개인과 개인의 분쟁, 개인과 국가 사이의 법률적 다툼에 대하여 최종적인 판단을 내린다. 사건의 당사자나 대리인들은 쟁점사항에 대하여 같은 법조문을 놓고 다른 법률해석을 주장하더라도, 궁극적으로 서로 다른 법률해석은 통일된 방향으로 변화되어야 한다. 주석서의 견해에 대하여 법률가들이 다양한 의견을 나누고 새로운 법령, 판례, 법이론 등을 확인하는 과정을 통해 법률해석에 통일을 이룰 수 있다. 법률가가 재판업무 및 법학연구를 위하여 주석서를 활용하는 과정에서 최신의 법령과 판례, 법이론의 현재와 법률가의 다양한 의견을 추가하여 활용할 수 있는 방안을 제안하였다.
Abstract
The court has the responsibility to determine the final interpretation of the law. The court hands down final decisions on personal disputes and conflicts between individuals and the state. Legal commentaries will stay true to their intention of providing diverse legal theories and enabling a unified legal interpretation only when law practitioners are allowed to discuss in depth laws, cases, and legal theories within the boundaries set by commentary authors. If law practitioners include the latest laws, cases, and legal theories as well as their opinions to existing commentaries in their judicial roles and legal studies, they will be able to obtain a unified legal interpretation without referring to other legal literature.

국립중앙도서관에서 인쇄 출판물을 대상으로 운영 중인 납본체계와는 달리 웹 아카이빙인 OASIS (Online Archiving & Searching Internet Sources)는 웹 사이트, 웹 자원 등의 온라인 디지털 자원을 대상으로 자원 수집, 관리 및 보존하기 위한 과정이 필요하다. 이에 본 논문에서는 웹 아카이빙을 위한 디지털 자원 납본 프로세스를 개발하기 위해 디지털 자원 납본 주체와 대상을 정의하였고, 납본 프로세스를 위한 단계별 정의와 기능을 명시하였다. 또한 디지털 납본 시스템 구성을 위한 업무 흐름도와 단위 업무에 따른 기능 정의와 정보 흐름을 위한 구조를 제시하였다.
Abstract
The National Library of Korea is administering a legal deposit system for the printed- publications. Whereas, OASIS(Online Archiving & Searching Internet Sources) has to design a system to collect, manage and preserve web sites and web resources for Web Archiving. The purpose of this study is to develop a digital deposit process for digital resources. As a result, this study defines the subjects and objects for digital deposits, and describes the definitions and the functions according to digital deposit steps. Also, this study designs the data flow diagram and proposes the function definitions on unit works and the structure for the flow of information.

본 연구는 외국인 난민의 한국 체류와 관련된 정보상황을 이해하고, 요구되는 정보와 정보원을 파악하여, 정보행태 관점에서 외국인 난민과 한국사회에 필요한 변화, 국제사회 속에서 한국의 역할, 도서관계의 정보 전문가적 대응 방안을 제시하였다. Dervin의 의미형성이론과 Chatman의 정보빈곤 이론을 바탕으로 연구설계가 진행되었다. 한국에 합법적으로 체류 중인 외국인 난민을 연구 참여자로 선정하였고, 인식, 상황, 행태를 조사하기 위한 반구조화된 심층면담을 진행하였다. 연구결과를 바탕으로 외국인 난민, 한국 공공 및 민간기관, 도서관계에 적용 가능한 정보서비스 방안을 제시하였다. 이는 관련된 실증적 연구를 보완할 수 있고, 실제 정보 문제 해결을 위한 정보서비스의 가치를 높일 것으로 기대된다.
Abstract
The purposes of this study include i) to understand the circumstances of exposure to information during foreign refugees’ stay in South Korea, ii) to investigate their information needs and the use of information sources, and iii) to propose the change needed in the Korean society, the role of South Korea in the global community, and the service direction of libraries and information professionals. To this end, legally recognized refugees who have stayed in South Korea were recruited for semi-structured in-depth interviews and observations on their perception, situation, and active behavior. The discussions were transcribed for coding. The codes were analyzed by content analysis technics based on relevant previous studies and factors of Dervin’s Sense-making theory and Chatman’s Information Poverty theory. Based on these analyses, this study proposed strategies for foreign refugees and individuals and public organizations, including libraries and NGOs, from an information service perspective. It is expected that the proposed strategies will supplement related empirical quantitative research and add value to information services for solving information problems.
